187. Disproportionate nature of mandatory death penalty for drug offences—It was contended that, because the sentence would necessarily be
overwhelmingly disproportionate in certain cases, it was tantamount to degrading or inhuman punishment.
HELD following Ong Ah Chuan v Public Prosecutor [1981] AC 649, it is
for the legislator to determine the appropriate punishment provided the dissimilarity in circumstances for which a different penalty is applicable bears a
reasonable relation to the social object of the law. The convictions were
however quashed on the ground that the trial Judge had clearly misdirected
herself on the issue of possession of the drugs. Shaik v State (1994).
