223. Allegation of wrong acceptance or rejection of ballot papers – Demand of particulars – Inability to answer particulars sought – Recount pending—Upon an application by petitioners for particulars about allegations of
wrongful acceptance or rejection of ballot papers the respondents were unable to reply unless they were granted a recount and had an opportunity of
verifying the allegations.
HELD the allegations had no basis unless particularised should be struck
out as the respondents could not plead thereto. Berenger v Virahsawmy
(1984).
