255. Office of emolument under the State – Census Superintendent – Permanent and temporary offices—The office of Census Superintendent is an
office of emolument and the holder cannot be returned as an elected member
of the Council of Government. The Letters Patent do not make any distinction between permanent and temporary offices. A person who has applied
for a post and who has been appointed to it, must be held to have accepted
the appointment until the contrary be proved, or unless the law provides a
specific mode of acceptance. Hitié v Naz (1891).
