313. Absence from Legislative Assembly—On 2 January 1989, the AttorneyGeneral moved that the Court should determine that the respondent had vacated his seat in the Assembly in terms of section 35 (1) (e) of the Constitution. By the time the judgment in the case was ready to be delivered, the Assembly had been dissolved. The Court nevertheless made observations regarding— (a) the evidential value of the official record of a sitting of the Assembly regarding the presence or absence of a member; (b) the right of the Speaker to summon members to a sitting of the Assembly on a certain date even though it had been adjourned to a later date.
