24. Conditions for consent (1) The controller shall bear the burden of proof for establishing a data subject’s consent to the processing of his personal data for a specified purpose. (2) The data subject shall have the right to withdraw his consent at any time. (3) In determining whether consent was freely given, account shall be taken of whether, inter alia, the performance of a contract, including the provision of a service, is conditional on consent to the processing of personal data that is not necessary for the performance of that contract.
