Environment and Land Use Appeal Tribunal (ELUAT)

Appeals under the Environment Protection Act, against a decision of a Municipal City, Municipal Town or District Council under the Local Government Act, under the Morcellement Act, and under the Town and Country Planning Act.

Why go here first

A planning or environment refusal is appealed here, not to a court. juris holds the Tribunal's published determinations, many of them read by machine from scanned pages.

The provision

The Tribunal shall— (a) hear and determine appeals— (i) under section 54 of the Environment Protection Act; (ii) from a decision of a Municipal City Council, Municipal Town Council or District Council under section 117 (14) of the Local Government Act; (iii) under section 7B of the Morcellement Act; and (iv) under sections 7 and 25 of the Town and Country Planning Act; and (b) exercise such other jurisdiction as may be prescribed in any relevant Act.

Time limit

The appeal periods sit in each relevant Act (Environment Protection, Local Government, Morcellement, Town and Country Planning), not in section 4. They have not been read verbatim, so juris states none.
