177. Broadcasting – Monopoly – Duties of Telecommunications Authority— The plaintiff, which had been informed by the then Telecommunications Authority, that its application for a broadcasting licence would not be granted until new legislation was enacted, claimed that its constitutional rights were being infringed. HELD (i) section 12 of the Constitution entitles any person to impart information through broadcasting subject to some measure of control by the State; (ii) the monopoly of the MBC in matters of broadcasting is repugnant to the Constitution; (iii) the Authority is empowered to grant a licence.
