9. Maximum pension
(1) Except in the case of a member of the Judiciary, a pension granted to
an officer appointed before 1 January 2013 shall not exceed two thirds of
the highest pensionable emoluments drawn by him in the course of his service.
(2) For the purposes of this section, an additional pension granted in
respect of injury shall not be taken into account, but where the officer is
granted an additional pension under this Act, the amount of the additional
pension together with the remainder of his pension or pensions shall not,
except in the case of a member of the Judiciary, exceed five sixths of his
highest pensionable emoluments in the course of his public service.
(3) A member of the Judiciary shall be entitled to such additional pension
as may be prescribed.
(4) For the purposes of this Act, the person holding the office of Director
of Public Prosecutions on 1 July 1993, the office of Solicitor-General on 1 July
2003, the office of Parliamentary Counsel on 1 July 2008 or the office of
Electoral Commissioner on 1 March 2009, shall be deemed to be a member of
the Judiciary.
