10. Liability to take further employment (1) (a) Every pension granted under this Act shall be subject to the condition that unless or until the officer has attained the age of 50, he may, if physically fit for service, be called upon by the President to accept an office, not less in value than the office which he held at the date of his retirement. (b) Where a pensioner so called upon declines to accept such office, the payment of his pension may be suspended until he has attained the age of 50. (2) Subsection (1) shall not apply in any case where the President, being of opinion that the officer is not qualified for other employment in the public service or that there is no reason to expect that he can be shortly re-employed in that service, otherwise directs.
