2. Interpretation InthisAct– “additional remuneration”, in relation to an employee, means the appropriate amount determined in accordance with, or specified in, the second column of the Schedule and corresponding to the basic wage or salary payable to the employee as specified in the first columnoftheSchedule; "appointeddate"means1January2014; “authorised officer” means the Permanent Secretary or any public officerauthorisedbyhim; “basicwageorsalary”– (a) means– (i) in relation to an employee whose basic wage or salary isprescribed,suchbasicwageorsalary,whetherornot the employee’s actual wage or salary exceeds the prescribed wage or salary or the employee is remunerated on a piece rate basis or employed on task work; (ii) inrelationtoanemployeeinrespectofwhomnowage orsalaryisprescribedoragreeduponinhiscontractof service, the total amount, by whatever name called, earnedbyhimasfromtheappointeddate; 29_The Additional Remuneration (2014) ACT 12/23/13 9:54 AM Page 664 664 Acts 2013 (iii) in every other case, the basic wage or salary agreed upon in his contract of service, whether or not the employee’s actual wage or salary exceeds the agreed wage or salary or the employee is remunerated on a pieceratebasisoremployedontaskwork;and (b) includes any previous additional remuneration granted under anyenactment;but (c) does notincludeany allowance,commission or other benefit notformingpartofanemployee’swageorsalarybutgivento himinadditiontohiswageorsalary; “comparablefull-timeemployee”meansafull-timeemployeewho– (a) hasthesametypeofemploymentrelationship; (b) isengagedinthesameorasimilartypeofworkoroccupation; and (c) is employed in the same establishment, enterprise or branch ofactivity, asapart-timeemployee; “employee”– (a) meansanypersonwhoworksorhasworkedunderacontract of service or apprenticeship, whether the contract is express or implied, oral or in writing, and whether the person is paid daily,weekly,fortnightly,monthlyorotherwise; (b) includesapart-timeemployee;but (c) doesnotinclude– (i) apublicofficer; (ii) alocalgovernmentofficer,anofficerofastatutorybody, an officer of the Rodrigues Regional Assembly, or an employeeofaprivatesecondaryschool,whoisgoverned bytherecommendationsmadeinthePayResearchBureau Report2013; "Minister"meanstheMinistertowhomresponsibilityforthesubject oflabourisassigned; 29_The Additional Remuneration (2014) ACT 12/23/13 9:54 AM Page 665 Acts 2013 665 "part-time employee" means an employee whose normal hours of workarelessthanthoseofacomparablefull-timeemployee; "Permanent Secretary" means the Permanent Secretary of the Ministryresponsibleforthesubjectoflabour; “publicofficer”hasthesamemeaningasintheConstitution.
