40. Possession of paper for currency notes
(1) Any person who, without lawful authority or excuse, makes use of or
knowingly has in his possession a paper with a word, figure, device or distinction peculiar to and appearing in the substance of the paper used for currency
notes or material upon which the whole or part of a currency note purporting
to resemble a currency note has been engraved or made or any facsimile of
the signature of any signatory whose signature has appeared or appears on
currency notes, shall commit an offence and shall, on conviction, be liable to
penal servitude.
(2) Any person who, without lawful authority or excuse, mutilates, cuts,
tears or perforates a currency note, or in any way defaces a currency note
whether by writing, printing, drawing or stamping or by attaching or affixing to
it anything in the nature or form of an advertisement, shall commit an offence
and shall, on conviction, be liable to a fine not exceeding 500,000 rupees.
