143. Prosecution
Where the Official Receiver or the trustee reports to the Court that in his
opinion a debtor or other person has committed an offence under this Act, or
where the Court is satisfied upon the representation of any creditor or member of the committee of inspection or upon lawful evidence that there is
ground to believe that the debtor or other person has committed any offence
under this Act, the Court, if satisfied that there is reasonable probability that
the debtor or other person may be convicted, may refer the matter to the
Director of Public Prosecutions who may exhibit an information before the
Supreme Court, the Intermediate Court or the District Court charging the
debtor or other person with the offence.
