12D. Non-payment of fixed penalty
Where a person who has been served with an FPN
under section 12B fails to pay the appropriate fine within
the time limit specified in the FPN and criminal proceedings
are instituted against him for the offence in respect of
which he was served with the FPN, he shall, notwithstanding
this Act or any other enactment, be liable, on conviction,
to a fine which shall not be less than twice the fixed penalty
in respect of that offence.
