5. Violence against passengers or crew (1) Subject to subsection (2), any person who does outside Mauritius any act on board an aircraft in flight, which if done in Mauritius, would constitute any of the offences specified in the First Schedule shall commit that offence and shall, on conviction, be liable to the penalty provided for that offence. (2) No prosecution shall ensue under this section where the act complained of is done in a country under the laws of which the act is authorised. (3) — (4) For the purposes of this section, an aircraft shall be deemed to be in flight during the period specified in section 4 (2).
