Section 325: Service of documents on foreign company in legal proceedings

325. Service of documents on foreign company in legal proceedings (1) A document in any legal proceedings may be served on a foreign company in Mauritius as follows— (a) by delivery to a person named in the register as a director of the foreign company and who is resident in Mauritius; (b) by delivery to a person named in the register as being authorised to accept service in Mauritius of documents on behalf of the foreign company; (c) by delivery to an employee of the foreign company at the foreign company’s place of business in Mauritius or, if the foreign company has more than one place of business in Mauritius, at the foreign company’s principal place of business in Mauritius; (d) by serving it in accordance with any directions as to service given by the Court having jurisdiction in the proceedings; or (e) in accordance with an agreement made with the foreign company. (2) The methods of service specified in subsection (1) are notwithstanding any other enactment, the only methods by which a document in legal proceedings may be served on a foreign company in Mauritius.
