Section 164: Saving as to accused person and spouse

164. Saving as to accused person and spouse Nothing in this Part shall render any person charged with having committed an offence punishable by law, or the husband or wife of that person, a competent witness at the trial of that person for such offence before any Court of criminal jurisdiction, except in cases where the offence is charged to have been committed against the person or property or conjugal rights of the husband or wife of the accused, in which cases such husband or wife shall be a competent and compellable witness.
