343. Deceiving purchaser
(1) Quiconque aura— (1) Any person who—

(4) (a) Notwithstanding sections 152 and 153 of the Criminal Procedure
Act, where it is averred that the deceived purchaser is a minor below the age
of 16 or a mentally handicapped person, the person charged shall, on conviction, be liable to imprisonment for a term of not less than 3 months together
with a fine of not less than 1,000 rupees.

Offenders Act shall not apply to a person liable to be sentenced under paragraph (a).
