74. Unfitness to stand trial
(1) Where an accused suffers from insanity and on arraignment is found
to be so suffering by a Court so that he cannot be tried on the information
filed against him, the Court may direct the confinement of the accused in a
mental health care centre under the Mental Health Care Act.
(2) The Court shall not make a finding under subsection (1) except on the
evidence of not less than 2 registered psychiatrists.
