13. Drugs in transit
(1) Subject to subsection (5), no person shall bring any dangerous drug
to Mauritius in transit, unless the dangerous drug is accompanied by valid
export and import authorisations.
(2) Where a dangerous drug in transit is accompanied by an export authorisation or diversion certificate and the Permanent Secretary has reasonable grounds to believe that the authorisation or certificate is false or has
been obtained by fraud or wilful misrepresentation of a material particular, he
may seize and detain the dangerous drug to which the authorisation or certificate relates.
(3) The Permanent Secretary shall, on being satisfied that the export authorisation or diversion certificate is valid, release any dangerous drug detained under subsection (2).
(4) Where a dangerous drug brought in transit is landed or transhipped in
Mauritius, it shall remain under the control of the Permanent Secretary and
be kept in a Government store.
(5) Subsection (1) shall not apply to a dangerous drug in transit by post
or to any dangerous drug bona fide forming part of the medical stores of any
ship or aircraft.
