46. Depositions – how taken
The witnesses shall be examined apart from each other, and their depositions shall be taken down in writing, by one of the clerks, read over to the
witness and shall be signed by the witness, the Magistrate and clerk and in
case of refusal or incapacity of the witness, the fact shall be recorded by the
Magistrate and clerk.
