70. Complainant not appearing
Where on the day and place appointed the accused appears or is brought
before the Magistrate, then if the complainant or informant having had notice

District and Intermediate Courts (Criminal Jurisdiction) Act
of the day appointed does not appear, by himself, his barrister or attorney,
the Magistrate shall dismiss the complaint, unless for some reason he thinks
proper to adjourn the hearing to some other day on such terms as he thinks
fit.
