9. Provisional decree
Subject to section 11—
(a) in the case of a petition under article 238-1 or article 238-3 of
the Code Civil Mauricien, where the Court is satisfied that the
divorce should be pronounced, the Court shall grant a provisional
decree;
(b) in every other case, where the Court is satisfied that the petitioner has established his case or that both parties are to blame,
the Court shall grant a provisional decree.
