Section 17: Access agreement

17. Access agreement (1) A licensee may, with the agreement of another licensee, have access to the electricity facilities of the other licensee. (2) Where the licensees are unable to agree on the terms of the access agreement within 60 days from the date of the request for access, either licensee may apply to the Authority to appoint an arbitrator. (3) Where a dispute is referred to the Authority under subsection (2), the arbitrator shall, subject to such procedure as it may deem appropriate, determine the matter. (4) An award made by the arbitrator under subsection (3) shall be deemed to be made under, and be regulated by, the Code de Procédure Civile wherever applicable. (5) The award of the arbitrator shall be made within 30 days from the date of the appointment of the arbitrator.
