26. Undertakers to be responsible for damage The undertakers shall be answerable for all accidents, damages and injuries happening through their act or default or the act or default of any person in their employment by reason of or in consequence of any undertakers’ works, and shall save harmless all authorities, companies, bodies and persons by whom any street is repairable, and all other authorities, companies and bodies collectively and individually, and their officers and servants, from all damages and costs in respect of those accidents, damages and injuries, and occupiers of land for which a wayleave has been granted shall not be answerable for any damage caused to the undertakers’ lines thereon or thereunder in the execution of the occupiers’ work, where all reasonable precautions were taken by the occupiers of the land to avoid damaging the undertakers’ lines.
