Section 41: Confidentiality

41. Confidentiality (1) No person who has, pursuant to any power conferred under this Part, obtained access to an electronic record, book, register, correspondence, information, document or other material shall disclose such electronic record, book, register, correspondence, information, document or other material to any other person except for the purposes of this Act or pursuant to an order made by the Judge in Chambers. (2) The Judge shall not make an order of disclosure under subsection (1) unless he is satisfied that— (a) the applicant is acting in the discharge of his duties; (b) the information is material to any judicial proceedings; or (c) the disclosure is otherwise necessary in all the circumstances.
