40. Effect of order
(1) An order of the Tribunal shall be binding on—
(a) the complainant and the respondent before the Tribunal; and
(b) all persons who have been summoned to appear as parties,
whether they have appeared or not.
(2) An order in any matter referred to the Tribunal for determination may
be operative from such date as the Tribunal may specify in the order, having
regard to all the circumstances of the case.
