8. Offences
(1) Every person who fails to comply with section 3, 4 or 5 of this Act or
with an order made under section 6 or with any regulation made under this
Act shall commit an offence and shall, on conviction, be liable—
(a) in the case of a general retailer (foodstuff), to a fine which shall
not be less than 5,000 rupees nor more than 50,000 rupees, together with imprisonment for a term not exceeding 12 months;
(b) in the case of a general retailer of white oil, to a fine which shall
not be less than 25,000 rupees nor more than 100,000 rupees,
together with imprisonment for a term not exceeding 12 months.
(2) Section 197 (1) of the Criminal Procedure Act and the Probation of
Offenders Act shall not apply to an offence under this Act.
