35. Licence and international agreement (1) Subject to subsection (2), a foreign fishing boat licence or foreign fishing vessel licence shall not be issued under section 34, unless there is an agreement— (a) between the Government of Mauritius and the State in which the fishing boat or fishing vessel is registered; (b) between the Government of Mauritius and an economic integrated organisation to which a member State of the organisation in which the fishing boat or fishing vessel is registered has delegated the power to negotiate fishing agreements; or (c) between the Government of Mauritius and a fishing association of which the owner or charterer of the fishing boat or fishing vessel is a member. (2) In the absence of an agreement referred to in subsection (1), the Minister may issue a licence under this section if the applicant provides such financial or other guarantees as he may determine.
