42. Termination of appointment by Commission (1) Subject to subsection (2), the Commission may require an insurer to terminate the appointment of an auditor or actuary of an insurer, where it has reason to believe that the person or firm concerned is not fit and proper to hold the office concerned. [Issue 1] I15 – 32 Revised Laws of Mauritius (2) The Commission shall not make a determination under subsection (1) without giving prior notice of its intention to act in accordance with subsection (1) and the reasons for so doing, and give the insurer and the person or firm concerned as auditor or actuary, the opportunity to make representations.
