15. Failure or inability to act (1) Where an arbitrator becomes de jure or de facto unable to perform his functions or for any other reason fails to act without undue delay, his mandate terminates if he withdraws from his office or if the parties agree on the termination. (2) Where a controversy remains concerning any ground referred to in subsection (1), any party may request the PCA to decide on the termination of the mandate. (3) Where, under this section or section 14, an arbitrator withdraws from his office or a party agrees to the termination of the mandate of an arbitrator, this does not imply acceptance of the validity of any ground referred to in this section or section 13 (3).
