29. Exercise of powers by holder of office
Where an enactment confers a power or imposes a duty on the holder of
an office as such—
(a) the power may be exercised and the duty shall be performed by
the holder of the office for the time being, or by an officer appointed
to act for him and, in the case of the head of a Ministry or department, by an officer who may be appointed to act as head of that
Ministry or department or to be in charge of that Ministry or department, as the case may be;
(b) the holder of the office may, if he is unable on any occasion to
exercise the power or perform the duty, unless he is by law
expressly prohibited from so doing, by instrument in writing,
appoint the deputy of the office to exercise the power and perform
the duty on his behalf.
