Section 82: Fitness or conduct of officer

82. Fitness or conduct of officer (1) Where it appears to the Director that an officer— (a) is unfit to discharge his duties by reason of incompetence or misconduct or for any other reason; (b) has been seriously negligent in the discharge of his duties; or (c) has failed to comply with section 100, the Director may cause an inquiry to be held by a Board of Inquiry consisting of one or more persons appointed by him and, if he does so, may, if he thinks fit, suspend, pending the outcome of the inquiry, the use of any certificate issued to the officer or recognised by the Director. (2) In the case of a certificate delivered by a foreign government, the Director shall inform the proper officer for such action as he deems fit. (3) An inquiry under this section shall be conducted in such manner as the Board of Inquiry thinks fit, and it shall, if it deems it necessary, be assisted by one or more assessors. (4) The Board of Inquiry— (a) may, if satisfied of any of the matters referred to in subsection (1) (a) to (c), cancel or suspend any certificate issued to the officer or withdraw the recognition of the certificate or censure him; and (b) shall make a report on the case to the Director.
