88. Recovery of expenses from employer
Where expenses are incurred in respect of a matter for which the employer of a seafarer is required to make provision under section 86 and—
(a) the expenses are incurred by the Government, or by a foreign
government and repaid to it on behalf of the Government, the
Government may recover them from the employer; or
(b) the expenses are incurred by the seafarer, he may recover them
from the employer unless the latter proves that under the terms of
his employment they were to be borne by him or that he would
not have been left behind but for his own wrongful act or neglect.
