17. PensionsAct amended ThePensionsActisamended– (a) insection6– (i) insubsection(1)(a),byrepealingsubparagraph(ii) andreplacingitbythefollowingsubparagraph– (ii) who has opted for the pension provisions effectiveas from1July2008– (A) on or after attaining the age of 55 on the appropriate new retirement date specified in the second column of the First Schedule corresponding to the appropriate month and year of birth specified in the first column ofthatSchedule;or (B) on or after attaining the age of 50, in special cases, with the approval of the President, on the appropriate new retirementdatespecifiedinthesecond 42 Acts 2009 column of the Second Schedule correspondingtotheappropriatemonth and year of birth specified in the first columnof thatSchedule; (ii) in subsection (2), by inserting, immediately after the words “ground of marriage”, the words “on or aftercompleting5years of pensionableservice”; (iii) by adding, after subsection (2), the following new subsection– (3) The gratuity granted under subsection (2) shall be computed in such manner as may be prescribed. (b) insection6B(b)– (i) by repealing subparagraph (i) and replacing it by thefollowingsubparagraph– (i) hasoptedforthepensionprovisionseffective as from 1 July 2008 and retires on or after attainingtheageof45undersection6(1)(c), no pension shall be payable to him until he attains the appropriate new retirement date specifiedinthesecondcolumnoftheSecond Schedule corresponding to the appropriate month and year of birth specified in the first columnofthatSchedule; (ii) in subparagraph (ii), by inserting, immediately afterthewords “andretires”,thewords “onor”; Acts 2009 43 (c) insection8– (i) in subsection (1)(b)(i)(A)(AB), by deleting the words “First Schedule” and replacing them by the words “ThirdSchedule”; (ii) insubsection(3)(b) – (A) in subparagraph (i), by deleting the words “Second Schedule” and replacing them by thewords “FirstSchedule”; (B) in subparagraph (ii), by deleting the words “Third Schedule” and replacing them by the words “SecondSchedule”; (iii) in subsection (4), by deleting the words “First Schedule”andreplacingthembythewords“Third Schedule”; (d) by renaming the Schedules as specified in the Second Schedule to this Act and rearranging them in the appropriatenumericalorder.
