30. Saving
(1) Nothing in this Part shall bar an action in damages under any other
enactment in respect of industrial injury suffered by an employee.
(2) Notwithstanding any other enactment, where in relation to an
employee, a claim referred to in subsection (1) is made against an employer
and the Court finds that the employee is entitled to damages, the amount to
be awarded as damages shall be reduced by the value, as determined by the
Court, of any disablement pension or other benefit payable to the employee
under this Part.
