39. Requirement for development permit Nothing in section 38 shall authorise— (a) any alteration or extension to, or rebuilding of, a building or work; [Issue 1] P11 – 30 Revised Laws of Mauritius (b) any increase in the area of the use made of the land from the area actually physically and lawfully used immediately before the coming into operation of the instrument therein mentioned; or (c) any enlargement, expansion or intensification of a use referred to in that section, unless the development permit is granted subject to any restrictions as may be prescribed.
