Section 41: Preservation of buildings or sites

41. Preservation of buildings or sites (1) The Minister may cause a survey of the buildings or sites in any area of Mauritius to be made with a view to determining whether, in accordance with regulations that may be prescribed, the preservation of any building or site is desirable for architectural, environmental, cultural or historical reasons. (2) Where, after considering the survey and after consulting the Commission, the Minister is of the opinion that any building or site ought to be preserved for a reason specified in subsection (1), the Minister shall refer the matter to the National Heritage Fund Board established under section 5 of the National Heritage Fund Act and recommend that the building or site be declared a national heritage under that Act.
