Section 67: Confidentiality and misuse of information

67. Confidentiality and misuse of information (1) No person shall disclose any information obtained in connection with the administration or execution of this Act unless that disclosure is made— (a) with the consent of the person from whom the information was obtained; (b) in connection with the administration or execution of this Act; or (c) for the purposes of any legal proceedings arising out of this Act or of any report of any such proceedings. (2) No person acting in the administration or execution of this Act shall use, either directly or indirectly, information which he has acquired, in that capacity, for the purpose of gaining either directly or indirectly an advantage for himself or his relative. P11 – 45 [Issue 1] Planning and Development Act (3) For the purposes of subsection (2)— “information” means information that is not generally known, but, if generally known, might reasonably be expected to affect materially the market value or price of any land; “relative” has the same meaning as in the Prevention of Corruption Act.
