31. Competent Court (1) Subject to subsection (2), prosecution for an offence under this Act shall take place, at the sole discretion of the Director of Public Prosecutions, before a Judge without a jury, the Intermediate Court or the District Court. (2) A prosecution for an offence under section 3 shall take place before a Judge without a jury. (3) Notwithstanding any other enactment, the Intermediate Court shall have— (a) jurisdiction to impose any penalty provided for an offence under this Act provided that the penalty for an offence does not exceed 20 years; and (b) power to order sentences imposed under this Act to be served consecutively provided that the terms of such sentences shall not in the aggregate exceed 30 years. (4) Sections 150, 151, 152 and 153 of the Criminal Procedure Act and the Probation of Offenders Act shall not apply to a conviction for an offence under this Act.
