41. Variation of licence or authorisation
(1) Notwithstanding any other enactment but subject to subsection (2),
the Commission may, by written notice to a private pension scheme, vary its
licence or authorisation.
(2) The Commission shall not vary a licence or an authorisation—
(a) restricting the activities of a private pension scheme; or
(b) including further conditions on a licence or an authorisation,
unless it has notified the private pension scheme of the proposed variation,
and the reasons for the proposed variation, and has given the scheme a reasonable opportunity to make representations to the Commission.
