46. Winding up by Court (1) Subject to any other enactment, the Commission may make an application to the Court for the winding up of a private pension scheme where— (a) it is satisfied that the scheme is not complying with this Act, the FSC Rules or any other enactment; or (b) it is in the interests of its beneficiaries or the public for such winding up. [Issue 5] P32A – 24 Revised Laws of Mauritius (2) Where an application to the Court for a winding up is made by a person other than the Commission, a copy of the application shall, at the same time, be served on the Commission who shall be entitled to be heard on the application. (3) The Commission shall be a party to any proceedings under any enactment relating to the winding up of the activities of a private pension scheme, and the liquidator in such a winding up shall provide the Commission with such information as the Commission may, from time to time, require about the activities of the scheme.
