8. General restriction on private pension activities (1) No person shall operate a private pension scheme unless the scheme is— (a) a trust, a Foundation or such body of persons as may be specified in FSC rules; and (b) licensed or authorised, as the case may be, under this Act. (2) Subsection (1) (a) shall not apply to a fund registered under the repealed Employees Superannuation Fund Act at the commencement of this Act. [Issue 5] P32A – 8 Revised Laws of Mauritius (3) Any person who contravenes subsection (1) shall commit an offence and shall, on conviction, be liable to a fine not exceeding one million rupees and to imprisonment for a term not exceeding 8 years.
