14. Act not applicable
This Act shall not apply where—
(a) a contracting authority has, before the commencement of
section 41 of the Finance (Miscellaneous Provisions) Act 2016,
issued a request for proposal in respect of a project;
(b) subject to The Public Procurement Act, there is an agreement or
arrangement between Mauritius and a foreign State for a project
which allows Mauritius to benefit from the expertise and development experience of that foreign State in a particular field.
