17. Water conveyed through ground of another
(1) Any proprietor who wishes to have any water, which he has a right
to use or dispose of, brought to his land for any purpose, may have the
water taken through intermediate lands, with the authority of the Supreme
Court, and upon payment of a fair compensation to be previously fixed by
arbitration.
(2) The water shall be conveyed in the way arranged by the proprietors,
or, where they do not agree, in the way decided by the Supreme Court, after
receiving the report of one or more experts.
