Section 122: Offences

122. Offences Any person who— (a) drives, or causes or permits a person to drive, a motor vehicle or trailer on a road without a certificate of fitness being in force in respect of that motor vehicle or trailer; (b) drives, or causes or permits a person to drive, a motor vehicle or trailer on a road where the certificate of fitness in respect of that motor vehicle or trailer is suspended; (c) drives, or causes or permits a person to drive, a motor vehicle or trailer where the use of that motor vehicle or trailer is prohibited; (d) fails to display in a conspicuous place on a motor vehicle, the certificate of fitness issued in respect of that motor vehicle; (e) fails to display in a conspicuous place on a trailer or on the motor vehicle drawing the trailer, the certificate of fitness issued in respect of that trailer; (f) obstructs a police officer, vehicle examiner or road transport inspector in the discharge of his duties; (g) when requested by a police officer vehicle examiner or road transport inspector, fails to produce the certificate of fitness in respect of the motor vehicle or trailer of which he is in charge; (h) fails to permit a police officer, vehicle examiner or road transport inspector to inspect his motor vehicle or trailer; (i) fails to permit a police officer, vehicle examiner or road transport inspector to inspect the certificate of fitness in respect of the motor vehicle or trailer of which he is in charge; [Issue 9] R27 – 98 Revised Laws of Mauritius (j) otherwise fails to comply with this Part, shall commit an offence and shall, on conviction, be liable to a fine not exceeding 25,000 rupees and to imprisonment for a term not exceeding one year.
