123A. Dangerous driving
(1) (a) Any person who drives a motor vehicle dangerously on a road or
other public place, or at a speed, or in a manner, which is dangerous to the
public, having regard to all the circumstances of the case including the nature, condition and use of the road or public place, and the amount of traffic
which is actually, or which might reasonably be expected to be, on the road
or public place, shall commit an offence and shall, on conviction, be liable to
a fine of not less than 10,000 rupees nor more than 20,000 rupees and to
imprisonment for a term not exceeding 6 months.
(b) In the case of a second or subsequent conviction, the offender
referred to in paragraph (a) shall be liable to a fine of not less than 25,000
rupees nor more than 50,000 rupees and to imprisonment for a term not
exceeding 12 months.
(2) Section 153 of the Criminal Procedure Act shall not apply to a fine
imposed under this section.
