123M. Provision of specimens
(1) Where a specimen of breath for a breath test or for analysis—
(a) is not sufficient to enable the test or the analysis to be carried
out; and
(b) is not provided in such a way, including administration or intake
of a thing which will affect the result of a breath test, as to
enable the objective of the test or analysis to be satisfactorily
achieved,
the specimen shall be deemed not to have been provided for the purpose of
this Act.
(2) A person shall provide a specimen of blood only if he consents to it
being taken by a medical practitioner or a nursing officer and it is so taken by
a disposable syringe.
