196. Non-payment under section 195 Where the owner or driver of a motor vehicle, as the case may be, who is served with a PEDN fails to pay the specified penalty within 21 days of the date of issue of the PEDN, he shall— (a) be presumed to have been the driver of the vehicle at the time of the offence; and (b) where criminal proceedings are instituted against him for the offence in respect of which he was served with the PEDN, be liable, on conviction, to a fine which shall not be less than twice the amount specified in the Eighth Schedule in respect of that offence.
