Section 40: Driving without licence

40. Driving without licence (1) No person shall— (a) drive a motor vehicle on a road unless he is the holder of a driving licence authorising him to drive a vehicle of that class or description; or [Issue 3] R27 – 36 Revised Laws of Mauritius (b) permit or employ any person to drive a motor vehicle on a road unless that person is the holder of a driving licence mentioned under paragraph (a). (2) Where any person contravenes this section, he shall commit an offence. (3) This section shall not apply to a person who is the holder of— (a) an international driving permit; or (b) a provisional driving licence where that person has complied with all the conditions subject to which the provisional driving licence was granted.
