20P. Test certificate
(1) This section and section 20R shall have effect for the
purpose of ascertaining whether the provisions of this Act relating to the construction and condition of—
(a) motor vehicles and trailers; or
(b) their accessories or equipment,
are complied with.
(2) The Minister may for the purposes of ascertaining
whether the provisions relating to the construction or condition
of motor vehicles or trailers, or their equipment, are complied
with, make regulations for—
(a) the examination of motor vehicles and trailers; and
(b) the issue of test certificates that certify the fitness of
motor vehicles and trailers to be used on roads.
(3) An examination made under this section shall be carried
out by a vehicle examiner.
(4) (a) Where a test certificate is refused, the vehicle examiner shall issue a report of the refusal stating the grounds
of the refusal.
(b) Any person who is aggrieved by the refusal may
appeal to the Commissioner within 15 days of the notification to him of the report.
(c) On an appeal under paragraph (b), the Commissioner shall cause a further examination to be made and
grant or refuse a test certificate.
